America has doubtlessly drifted to the left on virtually every social issue over the last two decades. Some 70% of Americans say they support same-sex marriage. One year after the Supreme Court shot down Roe v. Wade, approval of abortion has actually increased. Desire for the legalization of marijuana hovers around 68%.
On the other hand, conservatives have made serious inroads on at least one critical issue: how Americans view transgender ideology.
Opposition has swiftly grown, for example, against the participation of men in women’s sports. Roughly 69% of Americans disapprove of males competing against females, an increase from 62% only two years earlier. Americans also strongly oppose allowing anyone under the age of eighteen to obtain so-called sex change surgeries or drugs that may cause chemical castration. State legislatures around the country have systematically started to protect children from this butchery. Nineteen states currently restrict child genital mutilation surgery, and many more will likely follow suit.
The Left is losing the argument politically and culturally, but progressive judges are nixing statutes which protect women and minors, without reasoned justification.
United States District Judge James Moody earlier this month struck down an Arkansas law banning physicians from offering sex change procedures such as puberty blockers and surgeries for minors, referencing purported evidence that the risk of suicide increases for minors who do not obtain sex change operations. No such long-term evidence exists.

Arkansas Attorney General Tim Griffin noted in a statement that “Moody misses what is widely understood across the United States and in the United Kingdom and European countries: there is no scientific evidence that any child will benefit from these procedures, while the consequences are harmful and often permanent.” Griffin is absolutely correct. European countries are swiftly restricting puberty blockers and sex change surgeries for minors because an increasing body of medical evidence has demonstrated their harmful side effects.
Moody, an appointee of former President Barack Obama, nevertheless said “evidence showed that the prohibited medical care improves the mental health and well-being of patients and that, by prohibiting it, the state undermined the interests it claims to be advancing."
Democratic judges are using the same argument to strike down similar bans throughout the nation. United States District Judge Robert Hinkle, an appointee of former President Bill Clinton, likewise struck down a law in Florida that limited Medicaid coverage for sex change procedures, writing that “gender identity is real” and contending that the state’s moves violated violated the Affordable Care Act’s prohibition of sex discrimination.

Given the makeup of the Supreme Court, both of these rulings will likely be reversed and the states will retain the power to make these decisions. The entire Western world is seeing the horror caused by “gender-affirming care,” and with the current trajectory of public opinion, our country will likely continue to restrict these barbaric practices.
At the same time, it is obvious that leftist judges will rule however they need to rule in order to advance their ideological agenda. Republicans have long talked about the necessity of appointing strict constructionist judges, which is needed now more than ever.
