United States District Judge Amy Baggio, an appointee of former President Joe Biden, ordered the release of self-described transgender Mexican illegal alien Odalis Jhonatan Martinez-Velasquez after he was kept in detainment with other males.
Velasquez entered the United States illegally two years ago under former President Joe Biden and was released into the country. When he was detained and scheduled for removal last month by federal immigration officials, he was placed in a male detention center, according to a release from the Department of Homeland Security.
President Donald Trump had signed an executive order on the first day of his new administration making clear that males should not be “detained in women’s prisons or housed in women’s detention centers.” Baggio nevertheless ordered Velasquez released this week.
“Velasquez, a biological male, was placed in a men’s facility in alignment with the President’s executive order and for the safety of women in ICE custody,” Assistant Homeland Security Secretary Tricia McLaughlin said in the release.
Trump administration officials accused Baggio of caving to pressure from activists in favor of transgenderism and mass immigration as the reason she granted the release of Velasquez.
“The activist judge is ignoring the biological reality of sex, undermining ICE’s commitment to promoting safe, secure, and humane environments for women in custody, and subverting the American people’s mandate to restore commonsense to our immigration system and reject extreme gender fanaticism,” McLaughlin added.
