The civil rights offices for both the Department of Education and the Department of Health and Human Services revealed on Monday that they are investigating Harvard University and the Harvard Law Review over alleged discrimination “permeating the operations of the journal.”

The law magazine, which is published by an organization led by students at the Ivy League school, allegedly admits roughly half of editors while considering factors such as their membership in “underrepresented groups,” with race as the “first priority” in recruitment.

Trump administration officials indicated that such race-driven policies may violate Title VI of the Civil Rights Act, which makes clear that recipients of federal financial assistance are not allowed to discriminate on the basis of race, color, or national origin in their programs or activities.
